Terms of Service
These Terms govern your use of OVERSTIMULATED LIVE, operated by Overstimulated LLC. Please read them carefully.
1. The service
OVERSTIMULATED LIVE is a live social audio entertainment platform operated by Overstimulated LLC (the "Company"). We sell digital entertainment services and digital media only — live in-room actions, paid audience participation features, and downloadable / streamable clip access. We do not sell, manufacture, stock, or ship any physical goods.
2. Eligibility
You must be at least 18 years old to register, participate in, or make purchases on OVERSTIMULATED LIVE. By creating an account or completing checkout, you confirm that you meet this requirement and have the legal capacity to enter into this agreement.
3. Live in-room actions
Paid live actions (mute bands, mic policies, removals, music requests, overrides, etc.) are executed by trained moderators in real time inside an active live audio room, typically within 30 seconds. Final execution depends on active live-room context, room rules, and moderator availability. Some actions may be queued, deferred, or — in rare cases — refunded if they cannot be executed at all.
4. Override / save mechanic
Override actions can be countered live. Both sides may continue paying to escalate, and the amount may increase per round at moderator discretion. The Company is not responsible for the financial outcome of escalated overrides — by participating you accept this risk.
5. Clip purchases
Clip purchases are digital media unlocks. After payment, you receive instant streaming or download access tied to your account. Clips are licensed to you for personal, non-commercial use only. Redistribution, re-uploading, public broadcasting, or resale is prohibited.
6. Payments
All payments are processed by Stripe, Inc. Overstimulated LLC does not store card details. Prices are listed in U.S. dollars (USD) and charged as one-time payments. By completing checkout you authorize the charge to appear on your statement as "OS LIVE".
7. Refunds
Refund eligibility and the process for requesting one are described in our Refund & Digital Fulfillment Policy. The standard refund window is 7 days from the transaction date.
8. Acceptable use
Hate speech, threats, doxxing, harassment, impersonation, sexually explicit content, illegal content, regulated goods, and any content prohibited by Stripe's Restricted Businesses list are prohibited. Violations result in immediate removal from the room and forfeit of any pending paid actions, with no refund.
9. Account termination
We reserve the right to suspend or terminate any account that violates these Terms, our Community Rules, or applicable law. Outstanding paid actions on terminated accounts are forfeit.
10. Limitation of liability
OVERSTIMULATED LIVE is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Overstimulated LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the platform.
11. Governing law
These Terms are governed by the laws of the United States and the state of registration of Overstimulated LLC, without regard to conflict-of-laws rules.
12. Changes
We may update pricing, services, and these Terms at any time. Material changes will be posted on this page. Continued use of the platform after changes are posted constitutes acceptance.
